Service Description
California Pest Control provides professional pest management and extermination services to residential and commercial properties throughout the State of California. Our services include, but are not limited to, inspection and identification of pest infestations, application of pesticides and integrated pest management treatments, installation of preventive barriers and exclusion systems, rodent control and trapping programs, termite inspection and treatment, bed bug elimination services, bird and wildlife management, and ongoing maintenance monitoring programs. All services are performed by licensed technicians in accordance with California state regulations and the California Structural Pest Control Act. Specific treatment methods, products used, and service frequencies will be determined based on property conditions, pest species identified, environmental factors, and the customized service agreement developed for each client. We reserve the right to modify service protocols as necessary to comply with evolving regulatory requirements or to implement improved pest control methodologies.
No Guarantee or Warranty
California Pest Control does not guarantee complete elimination of all pests from your property. Pest control results vary based on numerous factors beyond our reasonable control, including but not limited to structural conditions of buildings, adjacent property infestations, weather patterns, seasonal pest behaviors, client compliance with preparation and prevention recommendations, and re-infestation from external sources. While we employ professional-grade products and proven treatment protocols, no pest control method can guarantee 100% effectiveness or permanent prevention of future infestations. Any recommendations regarding treatment timelines, expected outcomes, or maintenance schedules represent professional estimates based on typical conditions and do not constitute warranties. We expressly disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Clients acknowledge that pest management requires ongoing cooperation and that complete eradication may not be achievable in all circumstances.
User Responsibilities
Clients must provide accurate information regarding property conditions, known allergies, presence of children or pets, previous pest control treatments, and any other factors relevant to safe service delivery. You are responsible for preparing your property according to our provided instructions, which may include removing or covering food items, relocating pets, clearing access to treatment areas, and vacating premises for specified time periods when required. Failure to follow preparation guidelines may result in service delays, additional charges, or reduced treatment effectiveness. Clients must promptly report any adverse reactions, pest recurrence, or property concerns following treatment. You agree not to interfere with applied treatments, tamper with installed monitoring devices or bait stations, or apply additional pesticides without consulting our technicians. Payment is due according to the terms specified in your service agreement, and past-due accounts may result in service suspension. You must notify us of any changes to property access codes, gate procedures, or emergency contact information.
Limitation of Liability
To the maximum extent permitted by California law, California Pest Control's total liability arising from or relating to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, property damage not directly caused by our negligence, personal injury except where caused by our gross negligence or willful misconduct, or damages arising from your failure to follow our instructions. This limitation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory. Our liability for damage to your property directly caused by our negligent application of products or performance of services is limited to the cost of repair or replacement of the damaged item. You agree to indemnify and hold harmless California Pest Control, its officers, employees, and agents from claims arising from your breach of these terms, your negligence, or your unauthorized modifications to treatment areas.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and proprietary information contained on our website, marketing materials, service reports, and treatment documentation are the exclusive property of California Pest Control or our licensors. This includes but is not limited to our service methodologies, inspection techniques, customized treatment protocols, and integrated pest management programs developed through our professional experience. Clients receive no license or right to use our intellectual property except as necessary to receive the contracted services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our materials without prior written consent. Service reports and documentation provided to you are for your personal reference and insurance or real estate transaction purposes only and may not be used to solicit competing services, train other pest control providers, or establish independent treatment protocols.
Governing Law
These Terms of Service and any disputes arising from your relationship with California Pest Control shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in the county where the services were performed or in Sacramento County, California. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue in such forums. These terms are subject to applicable California regulations, including the California Structural Pest Control Act (Business and Professions Code Sections 8500-8692) and regulations promulgated by the Structural Pest Control Board. In the event of conflict between these terms and mandatory California law, such law shall prevail. The provisions of these terms are severable, and if any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Changes to Terms
California Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Material changes will be posted on our website with an updated effective date. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. For clients with active service agreements, significant changes affecting pricing, liability limitations, or dispute resolution procedures will be provided with at least thirty days' advance notice through the contact information on file. Non-material changes, including clarifications or updates reflecting regulatory changes, may take effect immediately upon posting. If you do not agree to modified terms, you must notify us in writing and discontinue services before the effective date of changes. Failure to object or continued acceptance of services after changes take effect will constitute binding acceptance.
